Representative Cases

• Represented cargo interests in handling the stranding incident of M/V “Cape Elise” in the Singapore Strait, overcame the carrier’s nautical fault exemption, and successfully rejected the contribution to general average;
• Represented NTOC, time - charterer of the floating crane ship "Wen Qiang 8" and subcontractor for a wind - farm construction project, in defending against major damage claims from the owners and subrogated underwriter of an LNG pipeline bridge due to an allision;
• Represented Zhenhua heavy industry to deal with the claim against M/V “MSC ROSA M” for the major damage to Quay Cranes at Nhava Sheva Container Terminal caused by allision;
• Represented China Petroleum Pipeline Engineering Company Limited to deal with the claim against M/V “Bulk Jamaica” for her intruding to pipelaying area in Bangladesh waters and grounding at the middle of the pipeline;
• Represented a Singapore based shipowner against a bankrupt Chinese shipyard and successfully reclaimed the hull under construction from other creditors;
• Represented Sime Darby Liquid Terminal to recovery the outstanding hire of shore tank by enforcing the lien on third party owned cargo;
• Represented Huatai Insurance obtained the first anti anti-suit injunction in mainland China on a B/L dispute over the Russian coal shortage on board MV “Ken Sirius”;
• Represented the insurance broker and his liability insurer to defend in the litigation raised by the owner of MV “Cheng Lu 15” who failed to obtain insurance indemnity from the Hull underwriter;
• Represented the cargo insurer in the off-specification cargo claim against the insured in the disputes over the policy liability and against the owners of MT. Golden Tiffany and MT. Golden Gion in the recovery case. The case was tried by the People’s Supreme Court in which the rule of calculation of the depreciation rate for the assessment of the loss of the cargo was established;
• Represented PICC to claim against the owner of MV.Oliva which was grounded and sunk with fully loaded soy bean in Nightingale Island water. The amount of the dispute was up to $250 million. Making it the the most expensive marine cargo claim ever settled by the PICC;
• Represented the hull insurer in the collision between MV. Friendly Zhejiang and Alaknanda in Singapore strait. The highlight of the case is in how to apply the rules of preventing collisions in the overtaking and crossing situations within a separation channel;
• Represented the cargo insurer in the famous case “MV. Bulk Jupiter”, in which the vessel sunk with fully loaded bauxite. The highlight of case is to argue whether the accident was caused by the inherent vice of the cargo and how the IMSBC Code applies;
• Represented the insurer in the recovery case of NEC LCD manufacture Co., Ltd under the enterprise property insurance and the integrated project insurance;
• Participated in the design of an aircraft finance leasing project and increased the credit for second-tier financing through performance guarantee insurance.
