      Michael Gu is the co-managing editor of the China Antitrust Law Journal published by LexisNexis. Michael Gu has been the exclusive author for the China chapter for The Public Competition Enforcement Review for recent nine years. He is also a frequent contributor to Competition Policy International, China Business Law Journal, Asia Law Business, and China’s Cai Xin (the leading financial magazine in China). Michael’s publications regarding China antitrust law, M&A, entertainment and art law are well received, widely reproduced and quoted. Work Highlights

Michael Gu is a co-founder and a principal competition partner of AnJie Law Firm based in Beijing. Michael is also an executive member of AnJie. Michael was a principal competition partner of another leading PRC firm prior to funding AnJie. Michael Gu also spent five years at the competition practices of Linklaters and Allen & Overy. He is among the few top practitioners in China who can provide clients with a full range of cutting-edge legal advice on all types of antitrust matters in China, covering merger filings, antitrust investigations, antitrust civil litigations and compliance audit and trainings.
 
Michael Gu received his LL.B. degree from Soochow University School of Law in 1993 and was licensed to practice law in the PRC in 1994. Michael Gu has a strong background in both legal education and economic research. He studied EU competition law under the EU-China Legal and Judicial Co-operation Program, sponsored by the PRC Ministry of Justice and European Commission, from 2002 to 2003. He also holds a master’s degree from the China Center for Economic Research at Peking University.
 
Michael Gu is also a seasoned corporate and M&A practitioner. Michael regularly advises multinational clients on their strategic investments in China and assists them in dealing with challenging and complicated legal matters.

Antitrust

As a competition law pioneer in China, Michael Gu has secured merger clearance from the Ministry of Commerce of the PRC (MOFCOM) for numerous merger transactions involving variety of industries (e.g. healthcare, pharmaceutical, electronics, manufacturing, consumer products, telecommunications, transportation, energy, financial service, etc.) Particularly in 2008, Michael successfully submitted the first merger filing under the Anti-Monopoly Law which also received the first approval from the Anti-Monopoly Bureau of the MOFCOM. Michael has also represented clients in high-profile antitrust investigation proceedings, antitrust civil litigations and leniency programs. Michael has successfully assisted clients in obtaining satisfactory results with respect to all these investigations, litigations and leniency applications. In addition, Michael frequently provides strategic preventive advices to clients with respect to the potential antitrust risks associated with distribution agreements, IP licensing, restrictive measures, marketing events, pricing and bidding process, etc.
Michael Gu has actively participated in the drafting process of the PRC Anti-monopoly Law and its implementing rules. He has submitted numerous suggestions and comments to the relevant legislative authorities. He has also been invited to present keynote speeches on the topics of anti-monopoly law and other legal issues at various seminars.

He advised Citibank on its strategic investment in Guangdong Development Bank, UBS AG on its strategic investment in Bank of China, Nikko Asset Management Co., Ltd. on its strategic investment in Rongtong Fund Management Company, DaimlerChrysler AG on its share purchase of Beiqi Futian Automobile Co. Ltd, Goldman Sachs on establishment of the first PRC securities company controlled by foreign investors, Scottish & Newcastle on its strategic investment in and cooperation with Chongqing Brewery Company, Volvo on its acquisition of a major PRC construction machinery manufacturer and Avenue Capital on its strategic investment in Century 21 China Real Estate.
