    Ms. Yang has focused on complex matters of commercial arbitration and litigation beyond 16 years for domestic and foreign clients. Ms. Yang has represented all kinds of international commercial arbitration and litigation cases before CIETAC, SCIA, SHIAC, BIAC, HKIAC and the people courts at all levels including the Supreme People’s Court. Ms. Yang was awarded as “up and coming” in the dispute resolution space (both litigation and arbitration) by Chambers and Partners 2019. She was also awarded as “Litigation Future Star” by Benchmark Litigation 2019.

I. Arbitration


  • · Representing investors along with a well-known foreign law firm before CIETAC in an investment and equity transfer dispute applying the law of HK and CIETAC arbitration Rules. The sum in dispute exceeded RMB 2 billion.
  • · Representing a foreign client to compel Chinese party to withdraw its application before CIETAC in a Sino-Foreign joint venture dispute. The sum in dispute exceeded RMB 2 billion.
  • · Representing a well-known Korean state-owned enterprise before CIETAC against another well-known Korean state-owned enterprise in a dispute over joint venture. The sum in dispute exceeded RMB 200 million.
  • · Representing a bond underwriter in a false statement of bond issuance dispute before SCIA relating to the judgment of the scope of underwriter’s due diligence investigation responsibility. The sum in dispute exceeded RMB 150 million. The arbitral tribunal finally dismissed all claims filed by applicant against the bond underwriter.
  • · Representing a Singapore company to answer domestic buyer’s damage and specific performance claims before CIETAC in an international commercial trade arbitration. After almost 3 years’ hearing, the Singapore company eventually won. The sum in dispute exceeded RMB 120 million. This case was selected into “the Belt and Road” Countries International Commercial Arbitration Reports’ of CIETAC.
     

II. Litigation


  • · Representing a securities company (defendant in the trial of the first instance, appellee in the trial of the second instance) in an infringement dispute arising from multi-level financial arrangement before the Supreme People’s Court. The sum in dispute exceeded RMB 300 million. This case relates to a complicated crossing between criminal law and civil law. Additionally, multiple legal relations, such as entrusted financing, asset management, inter-bank deposit are covered among multiple parties. Achieved a favourable settlement.
  • · Representing a large-sized domestic real estate enterprise in a dispute over cooperation against a HK public company before Beijing High Court relating to complicated legal issues including business cooperation arrangement, debt accession, and the domestic enterprise finally won the lawsuit. The sum in dispute was almost RMB 150 million.
  • · Representing an equity purchaser whose aim is to obtain mining concession to bring an agreement rescission lawsuit against a seller on the ground of fraud in a dispute over equity transfer, and the equity purchaser finally won the lawsuit after going through a trial of first instance before Intermediate People's Court, a trial of second instance before High People's Court and a retrial before the Supreme People’s Court. The sum in dispute was almost RMB 500 million.
  • · Representing a client to bring a retrial before the Supreme People’s Court relating to a series of complicated transaction arrangements including joint venture, trade and financing. This case has gone through nearly 20 years before this retrial and relates to more than 10 connected lawsuits. Eventually, the Supreme People’s Court was successfully persuaded to remand the lawsuit for a new trial.
  •  · Representing an investor in a dispute over investment relating to a crossing procedure between transfer of shares and corporation liquidation reorganization before High People’s Court of Jiangsu province. The investor finally won the lawsuit. The sum in dispute was almost RMB 160 million.
